WHY do people choose trusts?
There are several reasons someone may choose a trust instead of a will:
(1) Some people use a Trust to avoid probate.
(2) If a person owns real property in multiple states, they may choose a Trust to avoid the necessity of multiple probate proceedings when they die.
(3) A Trust is private. Some people have strong feelings about privacy.
(4) A Trust is a good incapacity planning tool.

wills?
There are several reasons someone may choose a will instead of a trust:
(1) A Will does not require you to retitle your assets. Some people do not want to go through the process of transferring their assets into a Trust. They may also be concerned that, over their lifetime, they will forget to transfer any newly acquired assets into their trust.
(2) A Will is typically less expensive and time consuming to set up.
